Home Owners Associations (H.O.A) Heads or Tails?
Heads: H.O.A. ‘s and restrictive covenants protect property values by enforcing consistent home maintenance and minimizing architectural deviance.
Tails: H.O.A ‘s Litter subdivisions with bureaucracy, imposing the will-and preferred painting color-of the majority upon the individual.
So you your cedar shakes need stained; your vinyl wrapped siding needs painted. Do you need permission from your H.O.A before proceeding.?
Now, most H.O.A’s are Harmless. Most will clean your streets, trim your trees, build public basket ball courts, and allow you to paint your house anything you want as long as its mustard pink. there are a few, however with more prohibitive regulations, and so you should always assume the answer to be “NO”.
In fact, some HOW’s will require you to hire an approved, HOA-contracted painting company. Others limit your paint manufacture choices or color choices to six or seven mass acceptable neutrals, and if you desire a different color, like a creamy yellow, you must wallow in the proper approval channels: submit paint swatches, list manufacture guarantees, attend board meetings, etc.………
Special restrictions may apply. If a near by house has a similar color pallet, for instance, then –OMG!!!!- TRY AGAIN!!!. Some HOA further specify exterior paint choices by body, trim, garage door, front door, and special features color. also,HOA’s may regulate the application as well as the selection of paint. These specific regulations will be stated in the master deed- and by Laws of the Association. Both documents should be publicly accessible.
Don’t Smirk, If you skip the approval process and paint your home forest green with out approval. and you neighbor hates forest green and complains, then the HOA can force you to comply. If you refuse, the HOA may place liens to encumber your property, and those liens can escalate: $100.00 the first month, $200.00 the second month, $300.00 the 3rd month and so forth. More than one home owner has been fined into submission. Document everything, Some HOA’S will demand evidence of original color approval lf a neighbor complains later, If you cant cough up the proof. Then you will pay to repaint your house.
Thankfully, most HOA’s don’t care what color you paint inside your house, and most are pretty reasonable about your exterior paint color. we have been working with H.O.A Community’s including Harbor Bay Alameda Ca 94502 since 2010.
